By downloading, installing, or using the Fliq application ("App," "Fliq," or "Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legal agreement between you and Brian Lowen ("Developer," "we," "us," or "our").
If you do not agree to these Terms, do not download or use the App. Your continued use of the App following any modifications to these Terms constitutes your acceptance of the revised Terms.
Fliq is an iOS application designed to help users review, organize, and manage their personal photo libraries on Apple iPhone and iPad devices. The App provides tools including:
The App requires iOS 17.0 or later and access to your device's photo library to function.
You must be at least 13 years of age to use Fliq. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent's or guardian's permission to use the App.
To purchase the Fliq upgrade through the App Store, you must be at least 18 years of age, or have parental consent as required by Apple's App Store terms.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control, solely for your personal, non-commercial purposes.

Fliq offers a one-time in-app purchase ("Fliq Upgrade") that unlocks additional features including unlimited daily reviews, Smart Group resolution, and achievements. This purchase is processed by Apple through the App Store and is subject to Apple's payment terms.
Purchase prices are displayed in the App and may vary by region due to local tax requirements and currency exchange rates. All prices are shown inclusive of applicable taxes where required by law.
If you have previously purchased the Fliq Upgrade, you may restore your purchase at no additional charge on any device signed in with the same Apple ID by using the "Restore Purchases" function within the App. The Fliq Upgrade is tied to your Apple ID, not to a specific device.
All purchases are processed by Apple and subject to Apple's refund policy. If you are unsatisfied with your purchase, you may request a refund directly from Apple through the App Store. We do not have the ability to issue refunds directly. Please visit reportaproblem.apple.com to request a refund from Apple.
Fliq requires access to your device's photo library to provide its core functionality. You may grant limited ("Selected Photos") or full library access. You can revoke this permission at any time through iOS Settings → Privacy & Security → Photos.
Permanently deleting photos from your photo library through the Recycle Bin is irreversible. While Fliq provides a Recycle Bin as a safety net between flagging a photo and permanent deletion, once you choose to permanently delete photos from the Recycle Bin, those photos are permanently removed from your device and iCloud Photo Library (if applicable) and cannot be recovered by Fliq or by the Developer.
⚠️ Important: You are solely responsible for any photos you choose to delete using Fliq. We strongly recommend reviewing photos carefully before emptying the Recycle Bin. Consider keeping iCloud or another backup active before performing large deletions.
You retain all ownership rights to your photos. Fliq accesses your photos solely to provide the service you have requested. We claim no ownership over any photos in your library.
You agree not to use Fliq in any way that:
The App, including its code, design, graphics, user interface, text, and all other content (excluding your personal photos), is the exclusive property of Brian Lowen and is protected by copyright, trademark, and other intellectual property laws.
"Fliq" and associated logos are trademarks of Brian Lowen. You may not use these marks without prior written permission.
Fliq integrates with several third-party services. Your use of these services is governed by their respective terms and privacy policies:
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
We do not warrant that: (a) the App will function uninterrupted or error-free; (b) any errors or defects will be corrected; (c) the App is free of viruses or other harmful components; or (d) the results of using the App will meet your expectations.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BRIAN LOWEN BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP.
Without limiting the foregoing, our total liability to you for any claims arising from these Terms or your use of the App shall not exceed the amount you paid for the App (if any) in the twelve (12) months prior to the claim.
In particular, we are not responsible for any photos deleted through your use of the App. You assume full responsibility for all photo deletion decisions.
You agree to indemnify, defend, and hold harmless Brian Lowen from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the App, your violation of these Terms, or your violation of any rights of a third party.
We may release updates to the App through the App Store from time to time. Some updates may be required for continued use. We reserve the right to modify or discontinue the App or any features at any time, with or without notice.
We reserve the right to modify these Terms at any time. We will provide notice of material changes through an in-app notification or by updating the "Last updated" date above. Your continued use of the App after changes take effect constitutes your acceptance of the new Terms.
These Terms remain in effect while you use the App. You may terminate these Terms by uninstalling the App from all your devices. We may terminate or suspend your access to the App immediately, without prior notice, if we believe you have violated these Terms.
Upon termination, all licenses granted under these Terms will terminate. Sections 8, 10, 11, and 12 shall survive termination.
These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association, held in Los Angeles County, California.
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm.
These Terms, together with our Privacy Policy (available at getfliq.app/privacy), constitute the entire agreement between you and Brian Lowen with respect to the App and supersede all prior agreements, understandings, and representations.
